ORGANIC LAW N° 08/2005 OF 14/07/2005 DETERMINING THE USE AND MANAGEMENT OF LAND IN RWANDA

This Law not only provides a legal framework for the use and management of land in Rwanda but also institutes the principles that will govern the legality of land rights. This Act also establishes land commissions  at  national,  provincial  and  the  City  of  Kigali  level  as well as at the district, town and municipal level. The  organization,  responsibilities,  functioning and  the  members  of  land  commissions  will be determined by  a Presidential order. This Law also defines urban land as land which is confined within the boundaries of towns and municipalities. Urban land can be part of public domain for instance, if it is land for collective settlements. This regulation also contains provisions for land registration, allocation and leasing of state land, transfer of land rights as well as rights and obligations of landlords.

Finally, this Law abolishes the “ubukonde” custom that was established under law n° 530/1 of  May  26,  1961  on  land  tenure  in  the  territories  of Gisenyi and Ruhengeri.
